The individual, Dr Paul Coceancig reserves the right, at his sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Dr Paul Coceancig grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

By agreeing to enter this site, you are stating that if you are a legitimate member of the public, and legitimately seeking treatment for your personal condition with us, that the details you have entered are correct, and that they wholly and solely relate and pertain to you, and that all information contained herein is for your private, personal, and exclusive professional medical use, and free of any other purpose or action or intent. Further you agree that you will not disseminate, comment upon, copy, print, expose, write about, refer to, or in any way use the confidential and privileged information contained in this website in any way. Additionally, you agree that you are entering this Site for your own personal and exclusive medical and personal purposes, and that you do not intend in any way to enact, begin, initiate, continue or contribute to any legal process or action that would be detrimental to Dr Paul Coceancig or its employees, customers or associates.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), Pty. Ltd. including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Dr Paul Coceancig, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial or legal enterprise, and for any purpose,  without Dr Paul Coceancig’s express prior written consent for specific and detailed authorisation against a specific and detailed request.

You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of Dr Paul Coceancig, Including any Dr Paul Coceancig account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, Including but not limited to personal identification or information, other than your own information, as provided for by the Site.

Purchases; other terms & conditions

Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site, including contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. The Medicare rebates stated are approximate, and may be inaccurate, and may not apply to you in part or in full, and rebates are not warranted or guaranteed. The materials on the Site with respect to products and services may be out of date, and Dr Paul Coceancig makes no commitment to update the materials on the Site with respect to such products and services.

Account, passwords & security

Certain features or services offered on or through the Site may require you to open an account (Including setting up a Dr Paul Coceancig ID and password). You are entirely responsible for maintaining the confidentiality of the information you hold for your account, Including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify Dr Paul Coceancig immediately of any unauthorized use of your account or password, or any other breach of security. Any information that you provide this website, is not considered medical information. Do not provide medical information to this website. Any information that you provide this website is at your sole discretion to provide.

Your use of the site does not grant you status as a patient of Dr Paul Coceancig. Any information given to the site by you remains your own information. Any opinions and requests for opinion made to the site does not constitute an agreement by Dr Paul Coceancig to accept you as a patient, nor agreement to take responsibility for your medical care, nor agreement to treat you.

In consulting Dr Paul Coceancig, you will provide a referral from a bona fide medical doctor, and in the absence of providing such a referral, or if you provide a referral, your personal general medical doctor will remain your primary care physician, whether you have one or not.

Any agreement to engage Dr Paul Coceancig or this site, is wholly limited to the provision of a consultation or review consultation, and to the time limit booked for, and is not an agreement to treat you or physically see you beyond this consultation. Any payment made for consultation or review made through this site is limited only to the consultation or review paid for, and alone, and without expectation or obligation to further the relationship without a further and seperate agreement to undertake and perform such specific treatment as would be agreed to, and in company and agreement with your primary care physician or primary referrer who remains and is expected to remain your primary medical carer.

You remain at liberty to seek out and obtain any other professional opinion and consultation of and for your condition. Dr Paul Coceancig recommends strongly that you are guided and advised in your clinical and personal decisions by your primary care medical physician. You should seek professional specialist opinions only from bona fide registered medical specialists, and who are experts in their specific medical field of training and knowledge and expertise.

The consultation or review paid is limited wholly and only to the consultation or review consultation itself and to no other action or follow on from it, and without specific authority and agreement to extend the clinical or consultative relationship beyond it. There is no obligation of Dr Paul Coceancig to follow up or act in any part upon the consultation, being the limit is to the time limit of the consultation booked and paid for by the client.

The client agrees to make the consultation entirely private and confidential and may not make any public commentary or opinion, whether adverse or positive or testimonial upon Dr Paul Coceancig, this Site, or on the opinions offered or paid for, and in any public domain or forum or conversation.

Indemnity

Violation of these terms of use

Dr Paul Coceancig may disclose any information we have about you (Including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Dr Paul Coceancig’s rights or property, or the rights or property of visitors to or users of the Site, Including Dr Paul Coceancig’s customers. You agree that Dr Paul Coceancig may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.

If Dr Paul Coceancig does take any legal action against you as a result of your violation of these Terms of Use, Dr Paul Coceancig will be entitled to recover from you, and you agree to pay, all reasonable legal fees and costs of such action, in addition to any other relief granted to Dr Paul Coceancig. You agree that Dr Paul Coceancig will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

Governing law; Dispute resolution

You agree that all matters relating to your access to or use of the Site, Including all disputes, will be governed by the laws of the United States and by the laws of the State of New South Wales, without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state of New South Wales and federal courts of Australia, and waive any objection to such jurisdiction or venue. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and legal fees. In the event of any controversy or dispute between Dr Paul Coceancig and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty [30] days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.

Void where prohibited

Dr Paul Coceancig administers and operates the www.Dr Paul Coceancig.com.au Site from its location in Newcastle, Australia; other Dr Paul Coceancig sites may be administered and operated from various locations outside Australia. Although the Site is accessible worldwide, not all features, products or services discussed, referenced, provided or offered through or on the Site are available to all persons or in all geographic locations, or appropriate or available for use outside of NSW. Dr Paul Coceancig reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on the Site is void where prohibited. If you choose to access the Site from outside New South Wales, you do so on your own initiative and you are solely responsible for complying with applicable local laws.

Privacy 

Dr Paul Coceancig’s Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Use by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

Privacy Consent

Whilst this Site does not collect or store your private medical information, once a booking is made by you, you will be asked to provide medical information either by way of private medical questionnaires or through the consultation process. These actions to gain medical information of you are protected under medical privacy laws and are stored securely using cloud based information servers. Such written information is obtained via email. Your clinical records obtained through the consultation service are also stored through medical data software.

In order to provide the patient with the highest standard of care, this practice is required to collect personal information from them. This information covers basic details such as name, address, telephone number and identifying photograph, as well as general details of social demographics, current health and past medical and surgical events. Without this general health picture, the surgeon is unable to provide an opinion of the patient’s condition, or plan a patient’s care effectively and appropriately. You agree that in requesting a consultation, that all conversations whether in person, by telephone or online may be recorded through photographic, audio or audio-visual means, for transcription, review, monitoring and records purposes. These recordings may be used (where available) when requested by legal authorities, or for the legal interest or benefit of Dr Paul Coceancig. Such recordings remain the proprietary property of Dr Paul Coceancig and may not form part of the formal medical record.

Naturally some of your provided or requested information is of a personal nature, and might also be regarded as personally sensitive, especially regarding the potential for public release. We value the need to safeguard this information on your behalf. In accordance with the principles laid down in privacy legislation and with government guidelines, we would like to assure our patients that…

  1. This information will only be used by the treating practitioner in order to deliver your care to the highest possible standards.
  2. This information will not be disclosed to those not associated with your treatment, (other than for professional education, public health, legitimate legal request or scientific purposes) without your express consent. If you wish for access to diagnostic content using online cloud storage mediums (such as YouTube), you should ask us.
  3. You may seek access to the information held about you (apart from copyrighted documents and records and of records that contains names, or details of other persons) and we will provide this access without undue delay and within 45 days of the received request date. This access might be by inspection of your records at the time of the appointment, or by special access, or by copying of information at other times (charges will apply, and you agree that distribution to you will not be made unless you agree to such charges being made). A minimum charge of $200 is made for simple requests, including for letter writing to other professionals on your behalf.
  1. There will be no charge made for requesting information, but there will be fees levied to cover the costs associated with the processing of this request by the copying of such information, as well as the staff time involved (including fees of processes where access may be denied). You may request to privately and confidentially view the “Records Costs Schedule” in this regard to become fully acquainted with these fees when you make your request. All requests must be in person, and not through 3rd parties, and specifically we will not provide records or copies of records when requested by legal representatives for whatever purpose.
  2. We will take reasonable steps to protect this information from misuse or loss and from unauthorised access, modification or disclosure.
  3. We will not normally distribute radiographs or clinical photographs to you (or to other persons unless you approve such distribution) until the cessation of treatment and only at the discretion of the practice. Such records remain the property of Dr Paul Coceancig, and in order to maintain the completeness of our records, we will normally keep all radiographs (unless we return them to you). If they were originally forwarded to us by the referring practitioner, (and only at the end of treatment and at discharge) these x-rays may be forwarded back to the referring practitioner at their request. Where the patient makes such a request, (or where a health practitioner makes such a request on behalf of a patient), fees for handling would normally be levied (handling and distribution will not occur until such fees are paid for by the patient). The practice reserves the right not to distribute such records to third parties, and entirely at the practice’s discretion.
  4. Where requests for radiographs or investigations are made by the practice, these results and radiographs will be kept by the practice as part of the formal record, and will NOT normally be distributed unless to other formally OMS registered specialist practitioners at their request, and this distribution will also attract a handling charge to the patient. X-rays will not be distributed to GP practitioners in either medicine or dentistry unless they were the referring practitioner and only at the discretion of this practice. In cases where the patient requests a second opinion, radiographs or investigation results will not be distributed unless a formal request by a specialist practitioner is accepted by the practice. The company reserves the right to use (and the patient/guardian will give consent for) radiographs, clinical photographs and demographic information for professional, educative or scientific purposes. All attempts are made for the anonymous use of such information.
  1. Our staff are trained to respect these principles at all times.
  2. Where a clients medical records are required under order of sub-poena or court order, you agree that there are fees for the distribution of such records and which are payable by the client.
  3. We record (through audio or audio-video) your conversation for quality and review purposes, and for assistance with our note taking. The recordings DO NOT form part of your medical record, but can be requested or provided to legal authorities if available. Recordings are not usually kept or stored following their review for quality assurance purposes.
 

This practice is committed to protecting the privacy and security of any personal information it obtains about individuals and recognises that it must abide with the provisions of the Privacy Act 1988 (NSW).

All conversations, interviews, or in-person reviews may be recorded, and these records may form part of your record. Not all interactions are recorded. These records are usually for AI transcription purposes, and in the event of video recordings (particularly for Orthodontic and Orthognathic reviews) may be posted to private internet servers for your home review (and only with your permission). Where recordings are required, and you do not approve, the surgeon has the discretion to deny the consultation or review taking place, which you will accept as reasonable.

We require your consent to collect personal information about you. Failure to provide consent may lead the practice to denying you access to consultation or treatment by us. Please read this form carefully and sign where indicated below. This practice collects information from you (including demographic and health data as well as radiographs and clinical photography) for the primary purpose of providing quality health care. We require you to provide us with your personal details and full medical history so that we may properly assess, diagnose, treat and be pro-active in your health care needs. This means we will use the information you provide in the following ways…

  1. Administrative purposes in running our practice
  2. Billing purposes
  3. Hospital admission purposes
  4. Disclosure to others involved in your health care, including medical doctors, dentists, nurses, ancillary health care providers and medical specialists outside of this practice. This may occur through referral to other doctors or dentists, or for medical tests, and in the reports or results returned to their use following our treatment
  5. Disclosure for research and quality assurance activities to improve individual and community health care and practice management
  6. Emergency situations whereby medical officers or hospitals are required to access patient records for treatment purposes
  7. Public health education, professional presentations and scientific publications. Normally radiographs, clinical photography and other investigations are retained by the practice as part of the complete record, and are not normally distributed to other practitioners without formal requests by them (and through the specific permission of yourself) and by a process of acceptance by us. Patients may be able to request of the radiology provider copies of their own x-rays, but this practice will not distribute radiographs obtained and held by the practice under any circumstances, unless it is to other registered and recognised OMS specialists or to the client’s referring practitioner, and who have a legitimate clinical interest in the disease and treatment proposed or previously given, or if it is for professional education, public health or scientific purposes. X-rays that have been supplied to this practice from referring practitioners and which have served as a basis for consultation, opinion or treatment will normally be retained by the practice as part of this practice’s clinical record. Patients, in supplying the practice with clinical radiographs for an opinion or treatment, acknowledge and agree that they are providing the x-ray on the basis that it cannot be returned to them except in exceptional circumstances, and then only with the permission of the treating surgeon, and entirely at their discretion. Charges for distribution and handling of information and records normally attract a levy to the patient and this must be pre-paid before distribution occurs (normally as a minimum $200 charge for simple requests). Records that are intended for use later in medico-legal action (against third parties) are released only on the basis of formal medico-legal agreements being signed, and medico-legal fees being agreed to. If you have any questions about how we use the information you provide us, or if you would like to change your details, please contact this office to speak with the receptionist. Any changes to health or demographic information must be provided to the surgery at the earliest opportunity. The patient/client takes responsibility for the accuracy of all information held about them.
 

All requests for dissemination of information must be by the patient or guardian, and in writing. Upon making a booking we will need the following initial data from you…

  1. Your full name as it appears on your Medicare card. If you are not an Australian Permanent resident, or do not have a Medicare card, we will need some other form of identification for you.
  2. Your date of birth… DD-MM-YYYY
  3. Your residential address
  4. A digital photo so that we can paste your image into our record, and therefore treat you as a face and not a name. This can be taken when you arrive at your consultation.
  5. Three telephone numbers. Your mobile, your home, your work, or your partner or carers phone numbers are appropriate. Please indicate the phone number which you will answer during normal work hours. Our staff also work during work hours, and will need to contact you during normal work times in order to help organise your care or arrange receipts or quotes or estimates or hospital organisations. Remember that we need carers or partners or parents to look after you. We would like to know who your carers are, so that we know who we are talking to, and who we can contact to care for you if you are being treated in a hospital (which is where we treat all our patients).
  6. Your Medicare card number, including the number beside your name.

Your private medical and/or dental insurer (you must tell us which kind if insurance policy you hold), the membership number, their telephone number, and the number that appears beside your name. If you also know the level of your cover, that would be good to know (Gold, Silver, Bronze or Bronze plus), as well as the date you started your health policy.
  8. The name, address and phone number of your referrer. If you do not have a dentist or orthodontic practitioner or medical-doctor, we can help assign you a person whom you can visit, who will make an appropriate assessment of you, and who can make an appropriate referral for you. If you already have an in-date referral, YOU Must send this to us. Do not rely upon your referrer to send it to us. It is very rare that we will receive referrals from other offices we do not know, and in a timely way necessary for your appointment to take place. We need to know who your primary care practitioner is. Dr Paul Coceancig neither operates a general dental practice or a general medical practice. You will need general dental or general medical support in order to assist his specialist surgical care of you.
  9. If you have have any records that your doctor would like to reveiw during your consultation, then it is us to you to make sure we have received these, and have placed them into our records files, so that they can be easily and efficiently accessed by the doctor during your appointment time. If you are sending us an email, call us to make sure that it was received by us and has not gone into junk mail, or was rejected by the server because the files were deemed to large, or had viruses attached.
  10. Your email address. We prefer Gmail. Hotmail presents us a lot of problems with respect of junkmail settings.
  11. A comprehensive medical history

Later, as you progress through your treatment, we will be acquiring medical data and a more comprehensive medical record from you. This may include…

  1. The dental records of your referring dental or orthodontic practitioner
  2. The medical records of your referring medical practitioner
  3. Records that you provide us
  4. Records that we independently obtain, including photography, radiology, pathology, hospital, and biomedical records, and finally
  5. Your personal history details

 

We will attempt to keep this overall record confidential, unless you agree that we may use them anonymously for audit or education or research purposes. If you request these records, or request their publication, or request distribution, we can no longer maintain the promise of their ongoing confidentiality.

Payment

Your consultation fee has been outlined as part of the booking process.

This is paid before you can make an appointment time with us.

Your pre-paid fee is NOT refundable if the appointment is cancelled or rescheduled for any reason. If you do not turn up for your appointment, we will still provide you a receipt, but you cannot claim any Medicare rebate for this.

Miscellaneous

You may not use or export or re-export any Content or any copy or adaptation of such Content, or any product or service offered on the Site, in violation of any applicable laws or regulations, including without limitation Australian export laws and regulations.

If any of the provisions of these Terms of Use are held by a court or other tribunal of competent jurisdiction to be void or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary and replaced with a valid provision that best embodies the intent of these Terms of Use, so that these Terms of Use shall remain in full force and effect. These Terms of Use constitute the entire agreement between you and Dr Paul Coceancig with regard to your use of the Site, and any and all other written or oral agreements or understandings previously existing between you and Dr Paul Coceancig with respect to such use are hereby superseded and cancelled. Other than as provided in a purchase agreement you enter into with Dr Paul Coceancig, Dr Paul Coceancig will not accept any counter-offers to these Terms of Use, and all such offers are hereby categorically rejected. Dr Paul Coceancig’s failure to insist on or enforce strict performance of these Terms of Use shall not be construed as a waiver by Dr Paul Coceancig of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between Dr Paul Coceancig and you or any other party be deemed to modify any provision of these Terms of Use. These Terms of Use shall not be interpreted or construed to confer any rights or remedies on any third parties.

Dr Paul Coceancig provides access to Dr Paul Coceancig international data and, therefore, may contain references or cross references to Dr Paul Coceancig products, programs and services that are not announced in your country. Such reference does not imply that Dr Paul Coceancig in your country intends to announce such products, programs or services.

Any feedback you provide at this site shall be deemed to be non-confidential. Dr Paul Coceancig shall be free to use such information on an unrestricted basis.
